Have you considered the possibility that at some time during your life you might be unable to handle your personal needs and financial affairs? These needs are reviewed during every estate planning session, and appropriate Powers of Attorney, Health Care Proxies, and other advance directives are used to assure you and your family that your needs will be met.
Do you want to provide for your own long term nursing care, and at the same time want to provide the estate you have accumulated to your family?
Are you concerned with meeting the needs of an elderly family member whose abilities are deteriorating? Perhaps they have not yet made effective provisions for a family member or other appropriate person might assist them in the event of their future incapability. Or have their abilities already deteriorated so that they are having trouble meeting their needs?
Do you have a family member with a disability, whether arising from the normal course of aging, due to an injury, or perhaps present from childhood? Do you need to provide a framework to help them meet their present or future needs in activities of daily living, and in providing for their financial and property management needs?
Have bank accounts, stocks, or perhaps the home, been taken or transferred without proper authorization? Do you need to know whether a court might order these to be returned?
These are just a few of the situations where special needs planning may be necessary. There are numerous tools which may be applicable to any given situation. However, each unique situation must be considered in view of the evolving framework of state and federal law. Elder law lawyer Arthur Olmstead can review your case, and then explain the alternatives which may apply. The range of possible solutions will vary, and may include:
- Durable Powers of Attorney to authorize appropriate persons to act for a person at some future time. These Powers of Attorney may be immediately effective, or may be effective in the event of a future incapacity.
- Health Care Proxies provide clear guidance and authority for medical care to be given in the event of your future inability to express your desires.
- Court proceedings may be necessary to formally appoint a guardian for a person if no effective provisions have implemented before their incapacity to provide for their needs.
- Special Needs Trusts may be established to apply assets to the future needs of a person or group of people.
- Various trusts may be used to make provisions for passing assets in lieu of a will, and also to meet medical and long term nursing care needs.
- Various transfers of real property and other assets may be permitted in certain circumstances while maintaining eligibility for Medicaid.
